Swapia is a local marketplace platform that allows users to buy and sell secondhand items. We provide:
- A platform to list items for sale
- Search and browse functionality by category and location
- Secure messaging system between buyers and sellers
- Favorites/wishlist functionality
3. User-Generated Content
IMPORTANT: Swapia does not review, verify, or endorse any items posted by users.
All item listings, descriptions, photos, and information are created by users, not by Swapia. We have no way to verify the accuracy, quality, safety, or legality of items posted on our platform.
4. Disclaimer - No Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES.
Swapia specifically disclaims:
- Any warranty that items listed are as described
- Any warranty regarding the quality, safety, or condition of items
- Any warranty regarding the accuracy of listings
- Any warranty regarding the identity or trustworthiness of users
5. Limitation of Liability
SWAPIA IS NOT LIABLE FOR ANY DAMAGES ARISING FROM TRANSACTIONS OR INTERACTIONS BETWEEN USERS.
You agree that Swapia shall not be liable for:
- Fraudulent transactions
- Misrepresentation of items
- Non-delivery of items
- Items not as described
- Any disputes between buyers and sellers
- Any personal injury or property damage
6. Payment and Transaction Risks
ALL TRANSACTIONS ARE CONDUCTED DIRECTLY BETWEEN BUYERS AND SELLERS.
Swapia does not process payments, hold funds, or provide any transaction guarantees.
Recommended Payment Methods:
- Face-to-face cash payment - Safest option
- Cashier's check or money order - Verify with issuing bank
- Instant transfer apps - Ensure transaction cannot be reversed (e.g., Venmo, Zelle)
Payment Methods to Avoid:
- Personal checks (can bounce)
- Wire transfers to strangers
- Any payment method that can be reversed after delivery
Shipping Risks:
- Buyer risk: Paying before receiving item - may never receive item
- Seller risk: Shipping before receiving payment - may not receive payment
- Both parties bear these risks when using shipping
7. User Responsibilities
As a user of Swapia, you agree to:
- Verify item condition and description before purchasing
- Communicate directly with the other party to confirm details
- Meet in safe, public locations for face-to-face transactions
- Use secure payment methods
- Report any suspicious activity to Swapia
- Not post prohibited items (see Section 8)
8. Prohibited Items
You may not post the following items for sale:
- Illegal items or substances
- Stolen property
- Weapons, ammunition, or explosives
- Prescription drugs without valid prescription
- Counterfeit or pirated goods
- Adult content or services
- Any items that violate applicable laws
9. User Conduct
You agree not to:
- Post false or misleading information
- Engage in fraudulent activity
- Harass, threaten, or scam other users
- Share personal contact information before both parties consent
- Spam or post repetitive content
- Attempt to circumvent our platform for transactions
10. Account Termination
Swapia reserves the right to terminate or suspend any account at any time for any reason, including but not limited to violation of these terms.
11. Intellectual Property
The Swapia name, logo, and all related trademarks are the property of Swapia. You may not use our branding without permission.
12. Dispute Resolution
Any disputes between users must be resolved directly between the parties involved. Swapia is not obligated to mediate or resolve disputes. Users agree to indemnify Swapia from any claims arising from transactions or interactions.
13. Changes to Terms
We may modify these terms at any time. Continued use of the Service constitutes acceptance of any modified terms.
